HOLLIS, N.H. — A Hollis man previously charged in a felony sex crime involving minors at a public library is now facing new criminal charges after police say he later engaged in a separate pattern of sexually explicit harassment while free on bail.

According to the Hollis Police Department, Zachary Hayner, 48, of Hollis, has been arrested in two unrelated incidents months apart, both involving allegations of lewd and inappropriate conduct.

Police say the first incident occurred on September 5, 2025, inside the Hollis Social Library, where staff reported an adult male following juvenile females throughout the building. After reviewing security footage, staff observed the man allegedly expose himself and perform a sexual act while seated at a table.

Officers later located the suspect nearby and identified him as Hayner. He was taken into custody and charged with gross lewdness in the presence of a child under 16, a Class B felony under New Hampshire law.

Court records show Hayner was later released on personal recognizance bail while the felony case remains pending in Hillsborough County Superior Court.

Months later, on December 8, 2025, police say a local medical facility contacted authorities after receiving dozens of disturbing phone calls traced to a Hollis-based number. Investigators determined that approximately three dozen lewd and harassing calls were made over several weeks.

Hayner turned himself in to police on December 18, 2025, and was charged with 13 counts of misdemeanor harassment. Despite being on bail at the time of the alleged phone harassment, police confirmed he was again released on personal recognizance pending arraignment in Nashua District Court.

Authorities say both cases remain active, and additional information from the public could aid ongoing investigations.

Why Was the Suspect Released While Charges Are Pending?

In New Hampshire, many defendants, including those charged with serious crimes, might be released before trial under specific legal conditions.

Types of Bail Explained
• Personal Recognizance Bail (PR):
The defendant is released without posting money but must agree to court-ordered conditions.
• Cash Bail:
Requires posting money to secure release.
• Preventative Detention:
A defendant may be held without bail if a judge determines they pose a serious risk to public safety or flight.

Bail Conditions Might Include:
• No contact with victims
• No new criminal offenses
• Court appearance requirements
• Travel restrictions

Violating bail conditions can result in re-arrest, additional charges, or revocation of bail.

In this case, police say the suspect was already on personal recognizance bail when the alleged harassment offenses occurred. Both cases are now moving through separate courts within Hillsborough County.

Important:
Release on bail is not a determination of guilt. All defendants are presumed innocent unless proven guilty in court.
